FIRST OFFENDER (WET RECKLESS) SERVICES CONTRACT The following agreement is entered into by and between the Alert Program and on this day of , . Goals: To improve public health and safety on highways by reducing the use and abuse of alcohol and other drugs while operating motor vehicles. To assist the individual in learning discipline and self-control through a treatment process designed for personal growth. Objectives: To educate each client by providing information about the effects of alcohol and other drugs as to their impact on the individual, family and community. To motivate each client to understand and accept responsibility for their decision about continued use/abuse of alcohol and other drugs. To motivate, support, and assist each client in making appropriate and permanent lifestyle changes to prevent further DUI offenses and/or other negative effects from alcohol and/or drug use and abuse. Program Requirements: 6 weeks as follows: 12 hours Alcohol Education. Self-help Meetings: In addition to the Program activities described above, attendance to approved self-help meetings dealing with alcohol problems is required. Each client will attend a minimum of 3 meetings of at least 1 hour and must be submitted by the final session. Credit is only given for one meeting attended in a 24-hour period. PROGRAM RULES AND REGULATIONS Attendance: Attendance is mandatory and punctuality is a must. Tardiness will be recorded as an absence. Absences: Client may not be absent from program activities for 21 days or longer (starting with the enrollment session); and no more than 2 absences will be allowed during the period of enrollment. All absences must be made up prior to completion and a $20.00 fee each assessed. The length of the program will be extended until all program activities are completed. Leave of Absence: Leave of Absences (LOA) must be approved by the Program Director in advance. The client must request for Leave of Absence if unable to attend program activities for 21 days or longer. Written documentation for the leave of absence, with two weeks prior notice, is required. Program Sobriety: Abstaining from the use of alcohol and other drugs is the desired goal for the duration of this program. Breath testing for blood alcohol level may be administered during the period of Program attendance. Positive test results or refusal of test indicate failure to maintain program sobriety and necessitate referral back to court. Attitude: Participation in group sessions, an open and receptive attitude, and a cooperative spirit are required. Undue hostility, belligerence, refusal to participate, or any form of rude, abusive or disruptive behavior will be grounds for exclusion from a session and/or possible termination from the program. Reports to Court Dismissal Policy: The Court or referring agency will receive reports on program participation as required and upon completion of program, and/or a report of non-compliance for any of the following reasons: Self-termination, is verbally/physically abusive; exceeds the maximum absences allowed; fails to do the following: participate in program activities for 21 days or longer without an approved LOA, maintain program sobriety, comply with program rules and additional program requirements, submit to a chemical test, pay assessed program fee within 30 days of due date (more than 15 days delinquent is grounds for suspension), reschedule or attend a financial assessment appointment. Should client's attendance necessitate requesting an extension of time for date of return-to-court, client shall be responsible for obtaining such an extension. No credit for services will be given after 2 years from termination date. Transfer: Transfer to another program or another County may be granted upon approval of the Program Director, following Riverside County DDP procedures. The transfer fee is $21.00. Grievance: If a client believes services have been denied based on race, color, sex, religion, place of origin, heritage or mental or physical handicap, or if client has complaints about policies, procedures, facilities, or the conduct of staff, notification of these grievances may be addressed in writing to Ms. Jacque Stewart, Director, Alert Program, Inc., 730 S. Eugene Rd., Palm Springs, CA 92264; or to the Riverside County DDP, 2085 Rustin Department 3, Riverside, CA 92507. Grievances regarding assessed fees may be directed to: Department of Health Care Services, Licensing & Certification Division, Driving Under the Influence – Licensing Unit, P.O Box 997413, MS 2602 Sacramento, CA 95899-7413. The toll-free complaint #: (877) 685-8333. Fees for Service: The total program fee is $222.00, which includes $17 State and $5 County surcharges. A $54.00 down payment is required with the balance payable either monthly at $112 or weekly at $28. The Program Director or his/her designee determines fee arrangements on an individual basis. There is a charge of $15.00 for returned checks. The Alert Program reserves the right to obtain client financial history and documented evidence of inability to pay. Services will not be denied if acceptable proof of inability to pay is provided. The undersigned agrees that in consideration of the services to be rendered, he/she individually obligates himself/herself to pay the fees of the Alert Program in accordance with the foregoing schedule. Participant may request a financial assessment in writing to determine the ability to pay program fee. The undersigned certifies that he/she has read the foregoing and has received a copy thereof. The undersigned also certifies understanding that failure to comply with the provisions of this contract will result in report back to Court for such non-compliance. A fee of $25.00 will be charged to be reinstated back into the program and/or to change from one program to another.
